In a Democratic-populated Senate, lawmakers will probably:

Confirm judges: If Republicans manage to win only the House, this basically means that the Democrats will still have full control over the Senate (even if by a short difference). There is not much they would be able to do in order to stop GOP House investigations into Biden.

However, they would most likely help the President out by approving his list of nominations for judges. As a matter of fact, this is probably the only thing that they might be able to do in a split Congress. The job is only the Senate’s purview, and Biden’s decisions can’t be attacked by Republicans.

As Trump did before him, Biden and his Senate Democrats tried very hard to fill as many as possible all the empty spots on federal courts all over the country, as they were aware of the impact these judges might have on any further investigations (such as the ones on Trump), but also on the disputes over various policy matters (such as forcing the current administration to continue the infamous decision on deportation policy known as Title 42).

Republicans win both chambers: The party that’s the least in power always gets to pick up seats in Congress during midterm elections. As Republicans have to pick up five (out of 435) seats in the House to grab the majority and only one out of 35 in the Senate.

Their glory moment has been shown by the overturning of Roe v. Wade, but it still might be possible for Republicans to take both chambers in Congress.

Stymie Biden’s agenda: During Biden’s first two years as the President of the United States, Republicans tried to work with him on a wide number of bipartisan matters, including infrastructure, veterans’ health benefits, competitiveness with China, and even gun safety.

However, only two years before another presidential election, Republicans are more decided to block Biden’s agenda. This can only mean that Biden should expect to see Republicans blocking as many spending requests for pandemic aid as possible, but also climate change decisions.

They might be even a couple of shutdown threats, as both of these sides will try to gain as much money as possible in spending bills.
